1. Introduction

Welcome to PawLuxe ("we", "us", or "our"). By accessing or purchasing from our online store at pawluxehq.myshopify.com (the "Store"), you ("Customer" or "you") agree to be bound by these Terms of Service ("Terms"). Please read them carefully before placing an order.

If you do not agree to these Terms, please do not use our Store.

2. About Us

PawLuxe is an online retailer of premium pet products. We are based in Denmark and operate under Danish and EU law.

3. Eligibility

By using our Store, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract. If you are purchasing on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Products and Pricing

4.1 Product Information

We make every effort to display our products as accurately as possible. However, colours and details may vary slightly depending on your device's display settings. Product descriptions are provided in good faith but are subject to change without notice.

4.2 Pricing

All prices are displayed in EUR and include VAT where applicable. PawLuxe reserves the right to modify prices at any time. The price applicable to your order is the price displayed at the time you place your order.

4.3 Availability

All product orders are subject to availability. We reserve the right to discontinue products or limit quantities at any time without notice.

5. Ordering

5.1 Placing an Order

By placing an order through our Store, you are making an offer to purchase the selected products. We will send you an order confirmation email upon receipt of your order; however, this does not constitute acceptance of your order.

5.2 Order Acceptance

Your order is accepted, and a binding contract formed, when we dispatch your goods and send you a shipping confirmation. We reserve the right to cancel or refuse any order at our discretion, for example in cases of pricing errors or suspected fraud.

5.3 Order Cancellation

You may cancel an order prior to dispatch by contacting us at mesfinelday97@gmail.com. Once dispatched, cancellations are subject to our Returns & Refunds policy below.

6. Payment

We accept the payment methods listed at checkout. All transactions are processed securely. By providing payment details you confirm you are authorised to use that payment method. Payment is taken at the time of order.

PawLuxe does not store your payment card details. All payment processing is handled by our payment provider in accordance with PCI DSS standards.

7. Delivery

7.1 Shipping

We ship to addresses within our supported delivery regions. Delivery times and costs are displayed at checkout and may vary by destination. Estimated delivery times are not guaranteed.

7.2 Risk & Title

Risk of loss and title to products passes to you upon delivery to the address provided at checkout. PawLuxe is not responsible for delays caused by the carrier or by incorrect addresses provided by you.

7.3 Failed Deliveries

If a delivery is returned to us due to an incorrect address or failed delivery attempts, we will contact you to arrange re-delivery. Additional delivery charges may apply.

8. Right of Withdrawal (EU Consumers)

If you are a consumer located in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason (the "Withdrawal Period").

8.1 How to Exercise Your Right

To exercise your right of withdrawal, notify us before the Withdrawal Period expires by sending a clear statement to mesfinelday97@gmail.com indicating your decision to withdraw. You may use the EU Model Withdrawal Form, though this is not mandatory.

8.2 Return of Goods

You must return the goods to us without undue delay, and no later than 14 days after informing us of your withdrawal. You bear the direct cost of returning the goods unless we have agreed otherwise.

8.3 Refund

We will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day we receive the returned goods (or evidence of return). We will use the same payment method you used for the original transaction.

8.4 Exceptions

The right of withdrawal does not apply to:

•       Goods that are made to your specification or clearly personalised

•       Goods that are liable to deteriorate or expire rapidly

•       Sealed goods that are not suitable for return due to health or hygiene reasons, if unsealed after delivery

9. Returns and Refunds

Outside of the statutory right of withdrawal, we accept returns of items that are defective, damaged on arrival, or not as described. Please contact us within 30 days of delivery at mesfinelday97@gmail.com with your order number and a description of the issue.

We reserve the right to offer a repair, replacement, or refund at our discretion. Refunds are issued to the original payment method within 10 business days of approval.

10. Intellectual Property

All content on the Store, including but not limited to text, images, logos, and product descriptions, is the property of PawLuxe or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

11. User Conduct

You agree not to:

•       Use the Store for any unlawful purpose

•       Provide false or misleading information

•       Attempt to gain unauthorised access to our systems

•       Use automated tools to scrape or harvest data from the Store

•       Post or transmit any content that is harmful, offensive, or infringes third-party rights

12. Privacy and Data Protection

We process your personal data in accordance with our Privacy Policy and applicable EU data protection law, including the General Data Protection Regulation (GDPR). By using our Store, you acknowledge that we will process your personal data as described in our Privacy Policy, available on our website.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, PawLuxe provides the Store and its products on an "as is" and "as available" basis without warranties of any kind, either express or implied, except as required by law. We do not warrant that the Store will be uninterrupted, error-free, or free of viruses.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Danish or EU law.

14. Limitation of Liability

To the fullest extent permitted by law, PawLuxe's total liability to you in connection with your use of the Store or any order shall not exceed the total amount paid by you for the relevant order.

We are not liable for indirect, incidental, special, or consequential damages, including loss of profits or data, arising from your use of the Store.

Nothing in these Terms affects your statutory rights as a consumer under EU or Danish law.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Denmark. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Danish courts, without prejudice to any mandatory consumer protection rights you have under the law of your country of residence.

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Store after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms constitute the entire agreement between you and PawLuxe regarding your use of the Store and supersede any prior agreements.
